Banking & Funds

Banking matters require a close review of both the contractual relationship and the documents supporting a claim. The office assists clients with lending, finance and related disputes, starting with an assessment of the file and the available options.

How we can assist

  • Review of loan agreements, amendments and termination notices.
  • Guarantees, security documentation and mortgage prenotations.
  • Overdue claims and settlement or restructuring negotiations.
  • Review of loan-servicer standing and authority.
  • Claim assignments and securitisation documentation.

For the first discussion

For an initial discussion, useful documents include the loan agreement, amendments, correspondence, formal notices and any court documents received.

Frequently asked questions

What should I request before considering a repayment proposal?

Request written terms showing the balance, instalments, interest, total cost and consequences of missed payments. A review considers affordability alongside the terms and any security.

I received a letter from a loan servicer. Where do I start?

Keep the complete letter and its envelope or email. Gather the agreement, recent payments and earlier arrangements so the claim and the current stage of the matter can be assessed.

Should a guarantor obtain a separate review?

Yes. The guarantee, amendments and notices need to be examined from the guarantor’s perspective. A proposal addressed to the borrower alone may not clarify the guarantor’s position.

These are general answers. Appropriate action depends on the facts and deadlines of each matter.
